1. GENERAL INFORMATION
Welcome to MYBAGISVINTAGE.
These Terms of Service govern your access to and use of the MYBAGISVINTAGE online store and website, including the purchase of products offered through the website.
MYBAGISVINTAGE is an online store specializing in vintage, pre-owned and collectible luxury fashion items, including handbags, clothing, shoes and accessories.
By accessing or using our website and placing an order, you agree to these Terms of Service and to our Privacy Policy.
If you do not agree with these Terms, please do not use our website or place an order.
MYBAGISVINTAGE is powered by Shopify, which provides the technology used to operate our online store. Purchases made through the website are transactions between you and MYBAGISVINTAGE.
2. PRODUCTS AND VINTAGE CONDITION
All products offered by MYBAGISVINTAGE are described as accurately and carefully as reasonably possible.
Many of our products are vintage and/or pre-owned. As a result, individual items may show signs of previous use, age, storage or wear.
Any material imperfections, marks, scratches, discoloration, missing accessories, alterations or other relevant characteristics known to us will be disclosed in the product description and/or photographs where applicable.
The photographs form an important part of the product description. Minor differences in color or appearance may occur depending on your device, screen settings and lighting.
Vintage character, normal signs of age and wear that have been clearly disclosed in the product description are not considered defects or lack of conformity.
Nothing in these Terms limits any mandatory consumer rights applicable under Spanish or European law.
3. AUTHENTICITY
MYBAGISVINTAGE specializes in authentic vintage and pre-owned luxury items.
We make reasonable efforts to verify the authenticity of products before offering them for sale, using available expertise, documentation and/or professional authentication services where appropriate.
Where an item is accompanied by an independent authentication certificate or other authenticity documentation, this will be stated in the product listing.
If you have any questions regarding the authenticity, provenance or condition of an item, you are welcome to contact us before placing an order.
4. PRODUCT AVAILABILITY
All products are subject to availability.
Because many of our products are unique vintage or pre-owned items, an item may only be available in a single quantity.
We reserve the right to correct obvious errors in product descriptions, prices or availability.
If an order has been placed for a product that is no longer available due to an inventory error or other circumstance, we will contact you and provide an appropriate solution, including a full refund where applicable.
5. ORDERS
When you place an order through our website, you agree to provide accurate and complete information necessary to process your purchase.
After placing an order, you will receive an order confirmation by email.
An order may be cancelled by MYBAGISVINTAGE where there is a genuine reason, including an obvious pricing or inventory error, suspected fraudulent activity, or inability to fulfil the order.
If we cancel an order after payment has been received, the amount paid for the cancelled order will be refunded.
Your statutory consumer rights remain unaffected.
6. PRICES AND PAYMENT
All prices displayed on the website are stated in euros unless otherwise indicated.
Applicable taxes are included or otherwise clearly indicated at checkout, as required by applicable law.
Shipping costs, where applicable, will be displayed before you complete your purchase.
We reserve the right to correct obvious pricing errors.
Payment must be successfully received before an order is processed and shipped.
7. SHIPPING AND DELIVERY
Orders are shipped to the countries and addresses available at checkout.
Estimated delivery times are provided for information purposes and may vary depending on the destination, carrier, customs procedures and circumstances outside our reasonable control.
Where a specific delivery date or period is required by applicable consumer law, the relevant statutory rights will apply.
Once your order has been shipped, you will normally receive tracking information where tracking is available.
For international shipments outside the European Union, the customer may be responsible for applicable customs duties, import taxes or other charges imposed by the destination country, unless otherwise stated at checkout.
MYBAGISVINTAGE is not responsible for delays caused by customs authorities or other circumstances outside our reasonable control.
8. RETURNS AND RIGHT OF WITHDRAWAL
For consumers located in the European Union and other jurisdictions where a statutory right of withdrawal applies, you have the right to withdraw from an online purchase within 14 days from delivery of the goods, without providing a reason, subject to applicable legal exceptions.
Our Return and Refund Policy explains the procedure for exercising this right and the applicable return conditions.
Unless otherwise required by law, the customer is responsible for the direct cost of returning an item when exercising the statutory right of withdrawal, provided that this information was clearly communicated before purchase.
Returned items should be handled only to the extent necessary to establish their nature, characteristics and functioning, as a customer would reasonably be able to do in a physical store.
Nothing in these Terms limits your statutory right of withdrawal.
9. REFUNDS
Where a refund is legally due, refunds will be processed in accordance with applicable law and our Return and Refund Policy.
Where permitted by law, MYBAGISVINTAGE may withhold reimbursement until the returned goods have been received or the customer has provided evidence that the goods have been returned.
The original standard delivery cost will be refunded where required by applicable law. Additional costs resulting from the customer’s choice of a more expensive delivery method may not be refundable where permitted by law.
10. LEGAL GUARANTEE AND CONFORMITY
Nothing in these Terms excludes or limits the statutory rights of consumers relating to defective, damaged or non-conforming products.
For second-hand goods sold by a professional seller in Spain, the parties may agree to a legal guarantee period shorter than the standard period applicable to new goods, but such period may not be shorter than one year, where permitted by applicable law.
The agreed guarantee period applicable to a particular purchase will be communicated to the customer as required by law.
A product is not considered non-conforming merely because it has characteristics of age, wear or imperfections that were clearly disclosed before purchase.
Where a product is defective or does not conform to the contract, the consumer’s statutory remedies will apply.
11. VINTAGE AND PRE-OWNED ITEMS
Due to the nature of vintage and pre-owned products, no two items are necessarily identical.
Natural signs of age, previous use and variations in materials may form part of the character and value of a vintage item.
Customers are encouraged to carefully review the photographs, measurements, condition description and disclosed imperfections before purchasing.
Any condition issues that are known to us and material to the purchase will be described in the product listing.
12. INTELLECTUAL PROPERTY
All content appearing on the MYBAGISVINTAGE website, including photographs, product images, text, graphics, logos, branding and other materials, belongs to MYBAGISVINTAGE or is used with appropriate permission.
You may not reproduce, copy, distribute, modify, publish or commercially use our content without our prior written permission, except where permitted by applicable law.

Our website may contain links to or integrations with third-party services, including payment providers, shipping providers, social media platforms and other services.
We are not responsible for the content, availability or policies of third-party websites or services.

Nothing in these Terms affects your statutory rights as a consumer.
16. EVENTS OUTSIDE OUR CONTROL
MYBAGISVINTAGE will not be responsible for delays or failure to perform obligations caused by circumstances beyond our reasonable control, including natural disasters, strikes, transport disruptions, customs delays, government actions, technical failures or other events that could not reasonably have been prevented.
Where such circumstances affect an order, we will take reasonable steps to inform the customer where appropriate.
17. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our business, website, services or applicable legal requirements.
The version applicable to your purchase will be the version in effect at the time your order is placed, unless otherwise required by law.
18. GOVERNING LAW AND CONSUMER RIGHTS
These Terms are governed by the laws of Spain, subject to any mandatory consumer protection provisions applicable in the country where the consumer resides.
Nothing in these Terms prevents consumers from benefiting from mandatory rights or protections granted to them under applicable European Union or national consumer law.
Any dispute involving a consumer will be subject to the jurisdiction of the competent courts in accordance with applicable mandatory consumer protection rules.
